Kern County Public Works only has the authority to grant these waivers to entities located within the unincorporated areas of Kern County. Please move forward with the waiver if your business is within the unincorporated areas. If your business is located in an incorporated city, please contact your city directly.

De Minimis Waiver Application

Waive a Commercial Business’ obligation to comply with organic waste requirements of SB 1383 regulations if the Commercial Business provides documentation that the business generates below a certain amount of organic waste material.

Space Constraint Waiver Application

Waive a Commercial Business’ or property owner’s obligations to comply with organic waste collection service requirements if evidence from its own staff, a hauler, licensed architect, or licensed engineer demonstrating that the premises lacks adequate space for the collection containers required for compliance.
